Terms of sales


Article 1 Purpose


The General Terms and Conditions of Sale described below detail the rights and obligations of the company Kiwip Technologies SAS registered with the MEAUX Trade and Companies Register under No. 818626293 and its customers in the context of the sale of Kiwip Technologies SAS products and services online on its e-commerce site: URL: www.kiwip.eu

Any service provided by Kiwip Technologies SAS, hereinafter referred to as “Kiwip” implies the buyer’s unreserved adherence to these general terms and conditions of sale.

Article 2 Product presentation


The characteristics of the products offered for sale are presented on our site. The photographs are not contractually binding. The Kiwip company cannot be held liable if errors have been introduced.

All the texts and images presented on the Kiwip website are reserved, worldwide

under copyright and intellectual property laws; their reproduction, even partial, is strictly forbidden.

Article 3 Period of validity of offers of sale


Products that are offered for sale are offered while stocks last. In the event of an order for a product that has become unavailable, the customer will be informed of this unavailability, by e-mail or by post, and reimbursed for all sums involved, as soon as possible.

Article 4 Product prices


Our site indicates prices in euros, all taxes included, excluding shipping costs. The amount of VAT is specified when the customer selects a product and the shipping costs appear on the screen at the end of the selection of the different products by the customer.

Kiwip reserves the right to modify its prices at any time but the products ordered are invoiced at the price in force at the time the order is placed.

The prices quoted include any discounts and rebates that Kiwip may be required to grant in view of its results or the assumption of certain services by the buyer. No discount will be granted for early payment.

Article 5 Ordering


The customer validates its order when it activates the “Confirm your order” link at the bottom of the “Summary of your order” page after having accepted these terms and conditions of sale. Before this validation, the customer is systematically invited to check each of the elements of its order; it can thus correct any errors.

Kiwip confirms the order by email; this information includes all the elements of the order and the customer’s right of retraction.

The data recorded by Kiwip is proof of the nature, content and date of the order. The order is archived by Kiwip in accordance with legal conditions and deadlines; the customer can access this archive by contacting the Customer Relations department.

Article 6 Terms of payment


Payment for orders is made by credit card, and or by PayPal payment and or by SEPA direct debit.

When registering the order, the buyer must pay a deposit of an amount defined by Kiwip or the full amount of the order depending on the product or service chosen by the customer in the catalogue.

Article 7 Withdrawal period


The Buyer has a period of fourteen clear days from receipt of the products to exercise its right of withdrawal without having to pay any penalties; with the exception of the cost of return.

If the fourteen-day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day.

In the event of exercising the right of retraction, the Buyer shall return the complete products accompanied by his or her wish to exercise his or her right of retraction in writing, as a registered parcel with acknowledgement of receipt.

All returns must be made with the original packaging and at the expense of the Buyer. Any trace of wear and tear or deterioration will result in the application of a penalty of 30% of the purchase value.

The Company shall reimburse the Buyer for the totality of the sums paid, as soon as possible and at the latest within fourteen days of the date on which the products were received by the Company.

Article 8 Late payment (clause applicable to professionals)


In the event of total or partial non-payment of the goods delivered on the day of receipt, the buyer must pay Kiwip a late payment penalty equal to one and a half times the legal interest rate.

The legal interest rate used is that in force on the day of delivery of the goods.

This penalty is calculated on the amount of the outstanding sum, excluding tax, and runs from the due date of the sum without any prior notice of default being required.

In accordance with Articles 441-6 c. com. and D. 441-5 c. com., any delay in payment automatically entails, in addition to the late payment penalties, an obligation for the debtor to pay a lump-sum compensation of €40 for collection costs.

An additional indemnity may be claimed, on presentation of supporting documents, when the recovery costs incurred are higher than the amount of the lump sum compensation.

Article 9 Delivery


All products are delivered without any guarantee as to delivery times, with the exception of deliveries to private individuals. The delivery deadline varies according to their address. It is set, for an address in mainland France, on the day of payment + 8 days and, for other destinations, on the day of payment + 1 month. In the case of a pre-order, the delivery times mentioned above apply from the day the products are officially put on sale on the site.

Article 10 Recycling


Kiwip offers a 1-for-1 take-back solution in accordance with the Environmental Code.

In other words, we can take back the used appliance when equivalent new equipment is purchased: Art R543-180 of the Environment Code:

“I. – In the case of the sale of household electrical or electronic equipment, the distributor, including in the case of distance selling, shall take back free of charge, or have taken back free of charge on its behalf, used electrical and electronic equipment which the consumer discards, within the limit of the quantity and type of equipment sold.”

“III. – The consumer is informed of the take-back conditions set up in application of I and II of this Article, systematically and in a visible and easily accessible manner. The information must be given to him or her before the deed of sale with regard to the take-back referred to in I of this Article.”

Take-back Decree of 8 October 2014-Article 1: For the free take-back of electrical and electronic equipment required by Article R. 543-180-I, the distributor is required to offer the consumer, systematically and in a visible and easily accessible manner, the following minimum solutions:

In the event of removal, at the point of sale, of the equipment sold: take-back of the used equipment at the point of sale.

In the event of delivery of the equipment sold at its place of use: take-back of the used equipment at this location upon delivery.

In the event of delivery to another place or according to other arrangements: collection of used equipment at the place of delivery; or a local collection system that the distributor finances and organises or has organised, which may, if necessary, include the distributor’s shops; or provision of a return solution via a postal or equivalent service for electrical and electronic equipment whose characteristics allow it.”
